Dipak Misra is an Indian judge, who worked as the 45th Chief Justice of India from 2017 to 2018. Moreover, he is the former Chief Justice of the Patna and Delhi High Courts. Dipak Misra Early Life and Career
Dipak Misra was born on 3 October 1953 in Cuttack, Odisha, India. Dipak Misra family and schooling details will be updated soon. He completed his graduation in Law at Madhusudan Law College, Cuttack, Odisha. He joined at the Bar Council on 14 February 1977 and started practicing at the Orissa High Court and the Service Tribunal. In the year 1996, he was appointed as an Additional Judge of the Orissa High Court. Then he was transferred to Madhya Pradesh High Court, where he was appointed as a Permanent Judge. In the year 2009, he was appointed as a Chief Justice of the Patna High Court, where he served till he was appointed as a Chief Justice of the Delhi High Court. Later in the year 2011, he was promoted as a Chief Justice of Supreme Court for thirteen months and then he was appointed as a 45th Chief Justice of India on 28 August 2017 till his retirement on 2 October 2018 and his post was replaced by Ranjan Gogoi.
Justice Dipak Misra and Justice Dalveer Bhandari appeared in the case on “Reservation in promotion” at Allahabad High Court. The judgment of the case reservation in promotions can be provided only if there are sufficient data and evidence to check the need. The bench has rejected the Uttar Pradesh government’s decision of providing reservation in promotion because they failed to furnish sufficient valid data. Justice Misra led the team which rejected the “1993 Mumbai serial blasts” convict Yakub Memon’s appeal to stop his hanging. At that time he received an anonymous letter which says “irrespective of the protection you may avail, we will eliminate you.” In the unprecedented overnight hearing at 3:20 am in 2015, a three-judge bench of the Supreme Court headed by Justice Dipak Misra canceled the Yakub Memon‘s last-minute petition for the death warrant. After a few hours, Memon was hanged.
In the “2012 Nirbhaya rape case”, the three-judge bench led by Justice Misra has confirmed the death sentence to the four convicts in May 2017. The bench of Supreme Court headed by Justice Dipak Misra has settled the “120 years old conflict over the Cauvery river.” In that case, he considered the lifeline of Tamil Nadu and Karnataka people and laid the important principles to effect that rivers are a national resource and it is not the property of any State. So sharing of waters must be an equal basis and further placed the requirement of drinking water at the highest pedestal. Then he appeared for various cases and gave perfect judgment boldly and honestly. In 2018, justice Misra was a part of the bench where they ruled out Section 497 of the Indian Penal Code dealing with adultery will no longer be a criminal offense, but it can serve as a reason for other civil issues like divorce. He was also honored as the warrior of gender equality, it was same like supporting equal rights for women and the LGBT community. Like scrapping of Section 497 of the Indian Penal Code, he legalized the homosexuality by partially striking down Section 377 of the Indian Penal Code as well as allowing entry for women of menstruating age group into the Sabarimala temple in Kerala.
