The Supreme Court on Monday again denied an emergency hearing on Calcutta high court justice CS Karnan’s plea to recall an arrest order issued against him for the disgrace of court. Justice Karnan, whose whereabouts are not known, had on May 12 sought a review of his conviction and the six-month jail sentence. Earlier, India’s anti-corruption watchdog can be designated in the absence of a head of the opposition, the Supreme Court, calling the 2013 law in its current form a useful piece of legislation.

His advice Mathews Nedumpara had said the court that Karnan was in Chennai, but police teams have been unable to follow the judge who is locked in an unprecedented showdown with the country’s top judges. “I have attempted a recall of the seven-judge bench’s order since no charges were constructed against justice Karnan,” Nedumpara had told. He also furnished a signed document authorizing him to appear on behalf of the controversial judge.

Justice Karnan’s lawyer said the top court that he wanted to tender an unconditional apology, but the apex court registry was not accepting his application. Last week, SC had condemned Justice Karnan to six months in jail while holding him guilty of contempt of court. It was a landmark judgment, as it is for the first time that a sitting High Court judge has been condemned. The apex court had directed the immediate arrest of Karnan.

Justice Karnan has been required of circulation of disparaging letters toward sitting High Court judges of the Madras High Court. He also allegedly signed about Supreme Court judges in his letters to the Prime Minister’s Office (PMO). Karnan was condemned of contempt by the top court on May 9. It came a day after the judge condemned Chief Justice of India JS Khehar and six other SC judges to five years in prison under the SC/ST Act.

The controversy started in January when Karnan wrote to Prime Minister Narendra Modi to order a debasement probe against judges of the Madras high court and the apex court.

Karnan also arrested these justices of caste bias, saying he was being singled out for being a Dalit. What happened was a string or orders the two sides issued against each other, causing embarrassment for the judiciary which is locked in a tussle with the government over the procedure of appointment of judges.
